Court proclaims Ifeanyi Odii PDP legitimate governorship candidate

The Abakaliki Division of the Federal High Court proclaimed Dr. Ifeanyi Odii as the legitimate governorship candidate of the People’s Democratic Party (PDP) on Friday after he won the party’s gubernatorial primary on May 29.

The court issued this decision in case number FHC/ABJ/CS/2020/2022, which was brought by Tochukwu Okorie against the PDP and the Independent National Electoral Commission (INEC).

The PDP primary in Ebonyi State on May 28 and 29 was canceled by the court at the request of Mr. Okorie because, according to him, it was held in blatant violation of the Court of Appeal’s order. This led to the postponement of the implementation of the Federal High Court’s ruling in Abuja that had named Joseph Sila Onu as the party’s chairman for Ebonyi State.

In a decision issued on April 13, 2022, Justice Ahmed Mohammed of the Federal High Court’s Abuja division recognized Joseph Silas Onu as the legitimate chairman of the PDP’s Ebonyi State branch.

Tochukwu Okorie, who was not pleased with the outcome, petitioned the Abuja Division of the Court of Appeal to overturn the lower court’s ruling through his attorney, Nkemakolam Okoro.

The Federal High Court’s decision was then appealed, and the appellate court granted the appellant’s plea for a stay of execution.

In his lawsuit, the plaintiff asked the judge to overturn the PDP’s activities that were made in defiance of the court’s current directives.

However, Justice Fatun Riman rejected the case and chastised Mr. Okorie for abusing court procedures by bringing identical cases in several Federal High Court jurisdictions around the nation.

Therefore, the court dismissed Mr. Tochukwu’s petitions because they were unjustified.
